NxtPoint, LLC (“NxtPoint,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the NxtPoint mobile application, website, and related services (collectively, the “Platform”).

By using the Platform, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Platform.

1. Information We Collect

Summary: We collect information you provide (account details, profile info, match data), information collected automatically (device data, usage analytics), and information from third-party sources (sign-in providers).

1.1 Information You Provide to Us

When you create an account and use the Platform, you may provide us with:

  • Account Information: Name, email address, phone number, date of birth, and password or authentication credentials
  • Profile Information: Preferred sports (e.g., tennis, pickleball), self-assessed skill level, city, and bio
  • Match Data: Match results, scores, opponent information, date and time of matches, and match location
  • Communications: Messages, feedback, support requests, and any other content you submit through the Platform

1.2 Location Information

NxtPoint does not collect precise geolocation data from your device. Instead, we collect location information that you voluntarily provide:

  • City: During account setup, you provide the city where you want to find matches. This city-level location is displayed on your profile and used for leaderboards
  • Match Addresses: When you create a match, you input a venue address (e.g., a park or court). This address is visible to other users so they can find the match location

We do not track your location in the background, and we do not access your device’s GPS, Wi-Fi, or cell-tower data.

1.3 Information Collected Automatically

When you access or use the Platform, we automatically collect certain information, including:

  • Device Information: Device type, operating system, unique device identifiers, mobile network information, and app version
  • Usage Data: Pages and features accessed, interactions with the Platform, session duration, crash reports, and performance data
  • Log Data: IP address, browser type, referring URLs, and access timestamps

1.4 Information From Third-Party Sources

We may receive information about you from third-party services, including:

  • Social Sign-In Providers: If you register or log in using a third-party service (e.g., Apple, Google), we receive your name and email as permitted by that provider
  • Analytics Providers: Aggregated usage data from analytics services that help us understand how the Platform is used

1.5 Biometric Data

NxtPoint does not collect, store, or process biometric identifiers or biometric information (as defined by applicable laws such as the Illinois Biometric Information Privacy Act). We do not use facial recognition technology or any other biometric scanning on any user-submitted content.

2. How We Use Your Information

Summary: We use your information to operate the Platform, match you with players, calculate ratings, improve your experience, communicate with you, and ensure safety.

2.1 Operating the Platform

We use your information to:

  • Create and manage your account, profile, and preferences
  • Enable match discovery by showing you available matches based on your location, skill level, and sport preferences
  • Calculate and update your skill ratings using our ELO-style rating system based on confirmed match results. Ratings are calculated via automated algorithms based on user-submitted match results; no human review is involved in individual rating determinations
  • Display leaderboards, match history, and player statistics
  • Process score confirmations between match participants
  • Provide customer support and respond to your inquiries

2.2 Communicating With You

We may send you:

  • Match confirmations, score updates, and rating changes
  • Service announcements, security alerts, and account notifications
  • Promotional communications about new features or updates (you can opt out at any time)

2.3 Safety & Integrity

We use your information to:

  • Detect and prevent fraud, abuse, and violations of our Terms of Service
  • Identify rating manipulation, fake accounts, and dishonest score reporting
  • Enforce our community standards and protect user safety
  • Comply with legal obligations

2.4 Improvement & Analytics

We use your information to:

  • Analyze usage patterns to improve Platform features and user experience
  • Conduct research and analytics to develop new features
  • Monitor and improve the performance and reliability of the Platform

3. How We Share Your Information

Summary: We share information with other users as part of the Platform’s functionality, with service providers who help us operate, and when required by law. We do not sell your personal information.

3.1 With Other Users

Certain information is shared with other users as part of the Platform’s core functionality:

  • Your profile name, sport preferences, and skill rating are visible to other users
  • When you create or join a match, other participants can see your name, rating, and general location (city-level)
  • Confirmed match results and scores are visible on leaderboards and match history

3.2 With Service Providers

We may share your information with third-party service providers who perform services on our behalf, including hosting and infrastructure (e.g., Supabase, Vercel), analytics (e.g., usage tracking), push notification delivery, and customer support tools. These providers are contractually obligated to use your information only to provide services to us and are bound by confidentiality obligations.

3.3 For Legal Reasons

We may disclose your information if we believe in good faith that such action is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request
  • Enforce our Terms of Service and investigate potential violations
  • Detect, prevent, or address fraud, security, or technical issues
  • Protect the rights, property, or safety of NxtPoint, our users, or the public

3.4 Business Transfers

If NxtPoint is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

3.5 No Sale of Personal Information

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

4. Data Storage & Security

Summary: We use industry-standard security measures to protect your data. Your data is stored on secure servers, but no method of transmission is 100% secure.

4.1 Security Measures

We implement appropriate technical and organizational measures to protect your personal information, including encryption of data in transit (TLS/SSL), secure database storage with access controls, regular security assessments, and authentication safeguards. However, no method of electronic storage or transmission over the Internet is completely secure. While we strive to protect your information, we cannot guarantee its absolute security.

4.2 Data Retention

We retain your personal information for as long as your account is active or as needed to provide you services. We also retain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

Account Deletion: When you delete your account, we remove your personal identifiers (such as your name, email address, phone number, and bio) from our active systems. However, match records — including scores, dates, and the outcomes used to calculate other players’ ratings — remain a permanent part of the Platform’s historical data. These records are necessary to ensure the accuracy and integrity of the rating system and leaderboards for all users. Any remaining match records will be disassociated from your personal identity and attributed to an anonymous or deleted user.

4.3 Data Location & International Transfers

Your information is stored and processed in the United States on servers provided by our service providers (e.g., Supabase, Vercel). If you are located outside the United States — including in the European Economic Area (EEA), the United Kingdom, or Switzerland — your information will be transferred to, and processed in, the United States, which may have different data protection laws than your country of residence.

Where required by applicable law, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, or other legally recognized transfer mechanisms, to ensure that your personal information receives an adequate level of protection when transferred internationally.

5. Your Choices

Summary: You can manage your account information, opt out of promotional emails, and request data deletion.

5.1 Account Information

You may update, correct, or delete your account information at any time through the app settings. If you wish to delete your account entirely, you can do so in the app or by contacting us. Please note that some information may be retained as described in Section 4.2.

5.2 Location Data

Since NxtPoint relies on city and address information you voluntarily provide (rather than device-based location tracking), you can update your city or remove match addresses at any time through the app. If you wish to limit what other users see, you may choose a general venue name rather than a specific street address when creating matches.

5.3 Push Notifications

You can opt out of push notifications at any time through your device settings. Disabling notifications may cause you to miss important updates about match confirmations, score submissions, and rating changes.

5.4 Promotional Communications

You may opt out of promotional emails by following the unsubscribe instructions in those messages. Even if you opt out, we may still send you non-promotional communications, such as those related to your account, security, or ongoing services.

6. Your Data Rights

Summary: Depending on where you live, you may have rights to access, correct, delete, or port your data. We will respond to verified requests within the timeframe required by law.

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Right to Access: Request a copy of the personal information we hold about you
  • Right to Correction: Request that we correct inaccurate or incomplete personal information
  • Right to Deletion: Request that we delete your personal information, subject to certain exceptions (e.g., legal obligations, fraud prevention)
  • Right to Data Portability: Request a copy of your data in a structured, machine-readable format
  • Right to Object: Object to certain processing of your personal information
  • Right to Restrict Processing: Request that we limit the processing of your personal information under certain circumstances

To exercise any of these rights, please contact us using the information provided on our Contact page. We will respond to verified requests within the timeframe required by applicable law (typically 30 to 45 days). We may ask you to verify your identity before processing your request.

7. California Privacy Rights

Summary: California residents have additional rights under the CCPA/CPRA, including the right to know, delete, and opt out of the sale of personal information. We do not sell personal information.

If you are a California resident, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide you with additional rights, including:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purpose for collection, and the categories of third parties with whom we share it
  • Right to Delete: You may request deletion of your personal information, subject to certain legal exceptions
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights
  • No Sale of Personal Information: We do not sell your personal information as defined under the CCPA/CPRA. We do not use or share your sensitive personal information for purposes other than those permitted by law

8. Children’s Privacy

Summary: NxtPoint is intended for users who are 18 years of age or older. We do not knowingly collect information from anyone under 18.

The Platform is intended solely for users who are at least 18 years of age. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take steps to delete that information as promptly as possible. If you believe someone under 18 has provided us with personal information, please contact us immediately.

9. Third-Party Links & Services

Summary: The Platform may contain links to third-party services. We are not responsible for their privacy practices.

The Platform may contain links to third-party websites, apps, or services that are not operated by us (e.g., map providers for match locations, app store links). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review the privacy policies of any third-party services you access through the Platform.

10. Cookies & Tracking Technologies

Summary: Our website may use cookies and similar technologies for functionality and analytics. You can manage your cookie preferences through your browser.

When you visit our website (as opposed to the mobile app), we may use cookies and similar tracking technologies to:

  • Essential Cookies: Necessary for the website to function properly (e.g., session management)
  • Analytics Cookies: Help us understand how visitors interact with our website to improve the user experience

You can control cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of the website. The NxtPoint mobile application does not use browser cookies.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated policy on the Platform, updating the “Last Updated” date, and — where required by law — sending you an email or in-app notification. We encourage you to review this Privacy Policy periodically. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated policy.
